Can I wear a military uniform in a photo?

My husband would like a professional photo of me to take on the road with him each time he gets deployed or goes on a trip, he has been asking over a year. A local photography studio is having a “Patriotic Photo Shoot” tomorrow with all flags and red white and blue backgrounds etc…so I signed up. She mentoined I should bring or wear whatever I have that resembles him..and it so happens he gave me an old Air Force flight suit WITHOUT PATCHES OR RANK on it to wear for Halloween and he had a patch with my name made for the left chest. Then he LOVED me in it…so I thought I could wear that…but after more thinking I didn’t know if it was appropriate. I can’t ask him because it is a surprise. Should I or shouldn’t I? And please explain answers, not just “yes” or “no” because that doesn’t help me to decide when I get mixed opinions…THANKS!!

mrsjvb, I have to take exception to your answer for the simple reason that I’m a Military reenactor, and I wear a uniform that isn’t, by what you say, my right to wear. I served in the US Navy for 4 Years (discharged as an IT3 in 1999), and my primary role in reenactments is as a US Air Force Lieutenant General. I’ve recieved compliments from current active duty flag officers on my uniform, and it has even passed an “official” inspection by an Air Force General during a performance by my group, who said that if he didn’t know I was a reenactor, he’d have thought I was the real deal despite my obvious youth in comparison to his own.

What it amouts to is respect. If you have the proper respect for the uniform and do not try to pass yourself off in ANY WAY as a member of the Armed Forces, no one can legally do anything. Some people might voice their opinion that it’s not right, but if you do tell them up front that its for a photo shoot and nothing more, you’ll be in the clear.
